The business relations between Nutcracker.online (Holzkunst Hoffmann) and the customer are based exclusively on the below indicated terms and conditions of service effective at the time of the order.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
With regard to entrepreneurs, these terms and conditions also apply to future business relationships, without having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they only become part of the contract if we have expressly consented to this.
Your order is an offer to us that terminates in a sales contract. Our receipt of your electronic order, or your receipt of our Electronic Order Confirmation does not signify our acceptance of your order. We reserve the right to accept or reject your order at any time after its receipt. We ship complete orders only, and do not ship partial shipments. A sales contract becomes legally effective when the items are shipped to the customer.
The Sales Contract is between Nutcrackerland.online (represented by Andreas Hoffmann of Holzkunst Hoffmann) and customer (Consumer or/and Entrepreneur).

Handcrafted items may vary from the photo as shown on your screen – in color, size and detail content. Also consider that item images may vary depending on your computer’s resolution.
The representation of products in our online shop shall not constitute a legally binding offer, but rather an unbinding online catalogue.
You can click on the products and move them in your shopping cart, before finishing the check out process you can remove and add items at any time and add or edit your personal data.
By clicking on the Buy button during Check out you are submitting a binding order for the goods in your shopping cart.
Receipt of your order is confirmed by an automated e-mail sent immediately after your order is submitted but does not constitute acceptance of a contract. We may accept your order by sending a separate order confirmation by e-mail or by delivering the goods within two days. We save the contract details and send the order details to you by e-mail. You can view previous orders in your customer account.
In the case of clerical or printing errors contained in our order confirmation, or should our prices be subject to technical transmission errors, we have the right of appeal. Any payments already made will be reimbursed to you immediately.

Please choose the one of most convenience to you. Shipping cost may partially depend on your method of payment. All prices displayed in our online shop are excl. VAT. Due to the fact that most orders are outside Germany, where the shop is based. Only with orders within EU Countries the currently valid VAT will apply, which will be added during check out.
Sales to non EU Countries may be subject to additional customs duties, import tax and fees. They are not paid by the seller but the responsible customs and tax revenue will bill the buyer.
Shipping costs are not included in the displayed price and will be listed separately in your order receipt during check out.

Right of Withdrawal
You are entitled to withdraw from this contract within a period of fourteen days without giving a reason. The withdrawal period is fourteen days from the day on which you or a third party stated by you who is not the carrier took possession of the last goods. In order to exercise your right of withdrawal, you must inform us about your decision to withdraw from the contract by making a precise statement (e.g. a letter sent by mail, a fax or an e-mail).
Dispatching the notification concerning your exercise of the right of withdrawal before the expiry of the withdrawal period is sufficient to meet the withdrawal deadline. If you withdraw from this contract, we shall repay all payments received from you. We will use the same means of payment you chose for the original transaction unless explicitly agreed otherwise. We can refuse the repayment until we receive the goods or until you provide proof that you returned the goods, whichever is earlier.
You shall return or hand over the goods without delay and no later than fourteen days from the day on which you informed us about your withdrawal from this contract. This period shall be deemed observed if you dispatch the goods before the expiry of the period of fourteen days.

Damage during Transport
If your ordered goods are delivered with obvious transport damage, please immediately report such errors to your delivery agent and contact Holzkunst Hoffmann as soon as possible. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.
Warranties and Guaranties
The statutory right to liability for defects applies. Information on any additional guarantees that may apply and their precise conditions can be found with the product and on special information pages in the online shop.
The European Commission provides a platform for online dispute resolution (OS), which you can find here: httpss://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
If you are an entrepreneur, German law applies to the exclusion of the UN Sales Convention. If you are a businessman within the meaning of the Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
The ineffectiveness of a provision of these terms and conditions has no effect on the effectiveness of the other provisions.
